Conditions of Participation for Exhibitors

§ 1 Registration

1. Registration takes place exclusively using the organiser's PDF or online registration form.
2. The registration is binding. The organizer decides on admission (§ 3).

§ 2 Inclusion and Recognition

By registering, the applicant accepts the conditions of participation, any "special trade fair, festival and exhibition conditions" and technical guidelines of the organizer as binding for himself and all of his employees at the fair. These regulations thus become part of the contract between the exhibitor and the organiser.

§ 3 Admission

1. Only those whose stand and exhibition content corresponds to the organizer's trade fair/convention concept can be admitted as exhibitors. The organizer can limit individual stand areas for objectively justifiable reasons, in particular if the available space is not sufficient.

2. The contract between the applicant as exhibitor and the organizer comes into effect with the written confirmation of admission. Admission will only be granted if the partial amount due after registration (50% of the invoice amount) has been paid within 30 days of receipt of the registration. Approval can be revoked if the requirements for granting it were not met or later ceased to exist.

§ 4 Subject to subsequent changes

1. In the event of unforeseen events that make it impossible to carry out the trade fair/convention as planned and for which the organizer is not responsible, the organizer is entitled to postpone, shorten, extend or temporarily cancel the trade fair/convention in whole or in part close or cancel. Exhibitor claims, for whatever legal reason, in particular for damages and reimbursement of expenses, are excluded. If the trade fair has to be closed as a result of force majeure or by order of the authorities, the exhibitor owes the agreed stand rent and all other costs to be borne in full.

2. If a date is postponed, exhibitors can request the cancellation of the contract if they can prove that the date overlaps with another trade fair that they have already booked. They only have to reimburse the costs incurred at their instigation.

3. The exhibitor is not entitled to any claims if the trade fair is shortened or only temporarily closed.

§ 5 Withdrawal by the exhibitor

1. If a cancellation is made by February 28th, 2023, the exhibitor will receive a full refund of the partial invoice amount paid up to that point. In the event of cancellations between March
1st, 2023 and May 1st, 2023, the organizer will charge 25% of the agreed stand rent including flat rates as a contribution to costs. In the case of later cancellations, the full invoice amount is due. The exhibitor shall also bear any other costs incurred at the exhibitor's instigation.

2. Withdrawal requires a written application. It only becomes effective when accepted in writing by the organizer.

§ 6 Stand allocation

1. The booths are allocated by the organizer with special consideration of the event concept and the theme specified by the trade fair/convention.

2. Until the hall plan is drawn up, the organizer will try to take into account the exhibitor's wishes regarding the shape and placement of the stand. A claim does not exist. After that, stands will be allocated according to availability.

3. The allocation of stands will be communicated in writing no later than 4 weeks before the trade fair

4. The organizer is entitled at any time to relocate the entrances and exits to the exhibition grounds as well as the emergency exits and passageways in the halls for compelling reasons.

§ 7 Subletting

1. The exhibitor is not entitled, without the permission of the organiser, to sublet or otherwise transfer the stand allocated to him in whole or in part, to exchange it or to accept orders for other companies.

2. In the case of non-approved transfer to third parties, the organizer is entitled to demand that the sub-tenant clear the stand, whereby the exhibitor's obligation to pay rent remains unaffected.

§ 8 Joint booths

If several exhibitors rent a stand together, each of them is jointly and severally liable. In the registration they have to name a joint representative. He is deemed to be authorized to make and receive all kinds of legal declarations for the exhibitors.

§ 9 Rent, costs, terms of payment

1. The stand rents and surcharges result from the registration or any “special trade fair, convention and exhibition conditions. The exhibitor must bear the additional costs for additional orders or other ancillary services.

2. The invoice amount plus the statutory VAT is due according to the terms of payment stated on the invoice.

3. The exhibitor's right to set-off and retention is excluded, unless it is based on undisputed or legally established claims.

4. In the event of an unsuccessful payment reminder and a corresponding written threat with the final payment deadline, the organizer is entitled to terminate the contract with immediate effect.

§ 10 Cancellation right of the organizer

1. The organizer is entitled to terminate the contract without notice if there is an important reason. As such, it applies in particular that

  1. The exhibitor is in default of payment and does not make payment within one week even after a reminder.
  2. The exhibitor disturbs other exhibitors or the trade fair or does not observe the organizer's instructions or house rules.
  3. The fair/exhibition does not take place in whole or in part - without prejudice to § 4.

2. The termination must be in writing. The organizer can demand a minimum of 50% of the agreed stand rent as compensation (flat-rate compensation). The assertion of greater damage is not excluded. The exhibitor is free to prove that the organizer suffered less damage than the alleged damage.

§ 11 Design, equipment

1. The exhibitor must erect the stand with sufficient stability, including the rear and side walls. Corresponding walls will be provided by the organizer and are included in the stand rental.

2. If the exhibitor does without these walls and comes with his own complete stand, the stand space rental is reduced to EUR 30.00 per m2 (excluding ancillary costs).

3. In the interest of a successful overall presentation, the guidelines and instructions of the organizer must be followed during construction and equipment.

4. The organizer can demand that stands whose construction has not been approved or which do not comply with the exhibition conditions are changed or removed. If the exhibitor does not comply with the written request within 24 hours, the organizer can arrange for the removal or modification at his expense. If the stand has to be closed, the exhibitor has no claims.

§ 12 Operation of the stand

1. During the opening hours of the event, the stand must be occupied with the registered goods, staffed with sufficient information staff and kept accessible to visitors. The premature dismantling of the stand is not permitted and can be punished with a contractual penalty.

2. The operation of loudspeaker systems, music/photograph performances, the demonstration of machines, devices and facilities of all kinds and similar projects require the written approval of the organizer. A permit that has already been granted can also be restricted or revoked in the interest of maintaining proper trade fair operations.

3. The exhibitor is responsible for waste disposal himself! The legal regulations must be observed when disposing of waste.

§ 13 exhibitor passes

The following exhibitor passes are included in the stand rental:

  • For stands up to 10 square meters: 2 exhibitor passes
  • For stands up to 20 square meters: 3 exhibitor passes
  • For stands larger than 20 square meters: 4 exhibitor passes

Additional passes can be ordered at a price of EUR 21.00 plus 19% VAT = EUR 25.00 per pass. However, a maximum of 8 additional passes per stand can be ordered. These passes are of course valid for all 3 days of the fair. The passes will be handed out during set-up in our trade fair office in the entrance area of the hall and must be collected from there by all exhibitors themselves. Without ID, there is no access to the hall on the days of the fair!

§ 14 Advertising

Advertising of any kind, in particular the distribution of printed advertising matter, but also addressing visitors, is only permitted within the stand without the express permission of the organizer.

§ 15 Direct Sales, Hospitality

1. The direct sale of goods to third parties is permitted.

2. The exhibitor is not permitted to provide hospitality, in particular the sale of food, drinks, refreshments, luxury goods and food of any kind.

§ 16 Photo ban

There is a general ban on filming at the fair.
Photographs are prohibited outside of the specially marked areas on the entire Boundcon site.
Exceptions are specially marked and provided with a traffic light system. The photographs may not be used commercially. The use of flashlight and continuous light is prohibited. Uninvolved persons and visitors who have not explicitly consented to this photo being taken may neither be photographed nor visible in the background. Offstage, ALL people photographed must actively agree to the photo being taken.
Boundcon employs its own photographers and videographers who are identified as such with a t-shirt and/or badge. They are commissioned to document the fair and the events on the stage. To this end, they are allowed to take photographs anywhere without restrictions. Guests and/or visitors will only be shown by our employees with their expressed consent.

§ 17 Fire Protection

Only flame-retardant materials are allowed to be used for stand decoration. Open flames are prohibited on the stand.

§ 18 Cleaning

The organizer takes care of the nightly cleaning of the aisles and exhibitor areas. The exhibitor is responsible for cleaning the stand area.

§ 19 Parking

Exhibitors have paid parking spaces directly at the exhibition center.

§ 20 Guarding

1. The organizer is responsible for the general surveillance of the halls and the outdoor area, but without liability for loss or damage. Guarding begins on the first day of assembly and ends when dismantling is complete.

2. The exhibitor is responsible for supervising and guarding the stand. This also applies during set-up and dismantling times.

§ 21 Liability, Insurance

The organizer assumes no liability for damage to exhibits, stand equipment or any consequential damage, unless the organizer is responsible for them due to intent or gross negligence. The organizer has taken out liability insurance for his legal liability, which only covers damage to third parties (visitors). Exhibitors, their staff and their assets are not included. Exhibitors are strongly recommended to insure their exhibits at their own expense.

§ 22 house rules

1. The organizer exercises domiciliary rights on the entire exhibition grounds during the construction, running and dismantling periods of the trade fair. He is entitled to issue general and individual instructions or to issue special house rules.

2. The exhibitor and his staff may enter the exhibition center one hour before the start of the fair and must leave it no later than one hour after the end of the fair. Overnight stays on site are prohibited.

§ 23 Forfeiture, Statute of Limitations

1. Claims by the exhibitor against the organizer from and in connection with the stand rental contract are deemed to be forfeited if they are not asserted in writing within one week after the end of the trade fair.

2. Otherwise, all claims by the exhibitor and his employees against the organizer shall become statute-barred six months after the end of the trade fair/exhibition.

§ 24 Collateral Agreements, Changes

Deviations from these Conditions of Participation, the admission or any other "Special Trade Fair, Festival and Exhibition Conditions" or technical guidelines must be in writing to be effective. Oral side agreements do not apply. This also applies to the cancellation of the written form requirement.
